Article 3
(1) This Law shall apply to all sectors, both public and private. (2) The provisions of this law apply to employers, workers and worker representatives.

Article 5
In the present law, terms and expressions below have the following meanings: i) equipment for work - any machine, apparatus, tool or installation used at work; j) personal protective equipment - any equipment designed to be worn or handled by a worker to protect against one or more hazards that could endanger them safety and health at work, and any addition or accessory designed to achieve this objective;
k) job - the place intended to include workstations located at the enterprise and / or Unit, including any other place in the area of enterprise and / or unit to which the worker has access to the activity; l) grave and imminent danger of injury - actual situation, lacking the current real and only opportunity to trigger an accident at any time;

Article 7
Paragraph (3) The employer has the obligation to implement the measures referred to in para. (1) and (2) on the following general principles of prevention:
a) avoiding risks;
b) risk assessment that can not be avoided;
c) combat risks at source;
d) adapting the work to humans, especially in terms of design workstations, choosing work equipment, work methods and production, to reduce the monotony of work, work with predetermined rate and reducing their effects on health;
e) adapting to technical progress;
f) replacement of what is dangerous with what is what is dangerous or less dangerous;

Article 13
In order to ensure the security and health work and to prevent work accidents and occupational diseases, employers have the following duties:
q) provide safe working equipment for safety and health of workers;

Article 37
(1) failure to take any of the legal measures of safety and health work by the person who had a duty to take these measures, if a serious and imminent threat of a work accident or occupational disease, constitutes a crime and is punished with imprisonment from one year to 2 years or a fine.
(2) If the deed stipulated in para. (1) has produced remarkable consequences, the punishment is imprisonment from one year to 3 years or fine.
(3) the deed mentioned in para. (1) committed the fault is punished with imprisonment from 3 months to one year or a fine and deed mentioned in para. (2) committed the fault is punished with imprisonment from 6 months to a year or a fine.

Article 38
(1) Failure by any person of obligations and measures set concerning safety and health, if this is creating a serious and imminent threat of a work accident or occupational disease, constitutes a crime and punishable with imprisonment from one year to 2 years or a fine.
(2) If the act referred to in paragraph. (1) has produced remarkable consequences, the punishment is imprisonment from one year to 3 years or fine.
(3) If the breach consists in restoration in function of plant, machinery and equipment prior to removal of all deficiencies for which it was stopped as their punishment is imprisonment from one year to 2 years or fine.
(4) the facts mentioned in para. (1) and (3) committed the fault will be punished with imprisonment from 3 months to one year or a fine and deed mentioned in para. (2) committed the fault is punished with imprisonment from 6 months to a year or a fine.

Article 4
In the meaning of this ruling, the terms and expressions below are defined as follows:
a) temporary or mobile site, hereinafter referred to as site - any site where work is carried out construction or civil engineering.

Article 5
b) Coordination of safety and health should be organized both in the study phase, design and drafting, as well as during execution of the works.

Article 16
c) health and safety plan must be part of project work and adapted to its content.

Article 17
Health and safety plan must:
d) a) state of health and safety requirements applicable to the site;
e) b) the specific risks involved;
f) c) indicate the precautions necessary to reduce or eliminate risks;
g) d) to include specific measures concerning work which falls into one or more categories listed in Appendix. 2.

Article 24
Own health and safety plan including all the health and safety measures specific to each contractor or subcontractor.

4. Objects fall
Workers must be protected from falling objects whenever it is technically possible, by means of collective protection.
Materials and equipment must be placed or stored so as to prevent their collapse or overthrow.
n case of necessity, must be provided passages will be covered or preventing access to dangerous areas.

5. Falls from height
5.1. Falls from height must be prevented with material resources, especially with solid protective railings, high enough and having at least one border, one hand and current interim protection, or other alternative means equivalent.
5.2. Trestle can not be made, in principle, only with proper equipment or with collective protection equipment such as railings, platforms or trapping nets. In If, due to the nature works, you can not use this equipment to be provided with means of access and must use seat belts or other safe means of mooring.

6. Scaffolding and ladders
6.1. All scaffolding must be designed, constructed and maintained so as to prevent their collapse or accidental displacement.
6.2. Working platforms, gangways and scaffolding stairways must be constructed, dimensioned, protected and used so that people do not fall or be exposed to falling objects.
6.3. Scaffolding must be checked by a competent person as:
a) before use;
b) at regular intervals;
c) after any change, the period of inactivity, exposure to weather or earthquake or other circumstances that could affect the strength or stability.
6.4. The stairs should have sufficient strength and be properly maintained. They must be correctly used in appropriate places and as intended.
6.5. Mobile scaffolding must be insured against involuntary displacements.

7. Handling
7.1. All lifting devices and accessories, including components and fixings, anchor and support, must be:
a) Well designed and constructed and have sufficient strength for use which they are intended;
b) correctly installed and used;
c) maintained in good working;
d) checked and undergo periodic tests and inspections according to relevant laws in force;
e) operated by skilled workers with appropriate training.
7.2. All material handling and lifting all accessories must have clearly marked maximum load value.
7.3. Handling, and their accessories may be used for purposes other than intended.
